- POI timing and positioning are estimates only

- Safety-related purposesAny cockpit-style, pilot-style, first-person, or three-dimensional view is a visual simulation for passenger entertainment only. It is not a cockpit instrument, synthetic-vision system, navigation display, or representation of actual terrain clearance, aircraft attitude, weather, traffic, visibility, or flight conditions. Pilots, crew members, and others must not use it to operate or navigate an aircraft or make aviation or safety decisions.Use of the App is at your own risk.---4. Accounts and AuthenticationYou may access the App using third-party authentication providers such as Apple Sign-In or Google Sign-In.You agree to:- Provide accurate account information
- Maintain control of your account credentialsWe reserve the right to suspend or terminate accounts at our sole discretion.---5. Subscriptions and PurchasesPaid FeaturesOutMyWindow offers optional paid features, including:- Auto-renewing subscriptions (e.g., monthly and annual plans)
- Non-recurring purchases (e.g., Day Passes or other limited-duration access)
- If offered, one-time purchases that grant access for the lifetime of the App ("Lifetime Access")"Lifetime Access" means access to applicable features for as long as the App and its services continue to be made available by us. Lifetime Access does not guarantee that the App will be available indefinitely.Day Pass ActivationA Day Pass provides 24 consecutive hours of access to the features identified in the applicable purchase screen. Completing the purchase does not immediately begin the 24-hour access period.The access period begins automatically the first time you open or use the App while the App identifies a selected flight as live (a "Live Flight"). Once activated, the Day Pass continues to run for 24 consecutive hours and expires whether or not you keep the App open or continue using it. Activation depends on flight data and App systems that may be delayed, incomplete, or inaccurate. The App's displayed activation and expiration status will govern your access, subject to correction of technical or transaction errors.---BillingPurchases and subscriptions are processed through the billing system for the platform from which you obtained the App: Apple App Store In-App Purchase on Apple devices or Google Play Billing on Android devices.- Payments will be charged to the Apple Account or Google Account associated with the applicable platform store
- Subscriptions automatically renew based on the billing cycle shown at purchase unless canceled before renewal
- You may manage or cancel subscriptions through your Apple App Store or Google Play account settings, as applicableUnless expressly stated otherwise, we do not offer purchasing methods outside the applicable platform billing system.We use RevenueCat, a third-party purchase and subscription-management service, to validate receipts or purchase tokens, manage and restore entitlements, and receive transaction, renewal, cancellation, refund, and reporting information. RevenueCat is not the platform store or the payment method used to complete your purchase.---Pricing and ChangesWe reserve the right to modify pricing, features, and available purchase options at any time.Changes will not affect active subscription periods but may apply to future purchases or renewals.---Refunds and Finality of PurchasesBilling is handled through Apple App Store In-App Purchase or Google Play Billing, as applicable. - Errors in pricing or entitlementWe may use RevenueCat and applicable platform information to determine and administer entitlement status.---Feature AvailabilityFeatures included in paid plans may change over time.We do not guarantee that any specific feature will remain available for any particular duration, including for users with Lifetime Access.---6. - Scrape, copy, or reuse POI data or other content
- Use the App for commercial purposes without permission
- Interfere with or disrupt the App or its infrastructure

- Design, branding, and UI

- Purchase and entitlement management providers (including RevenueCat)
- Infrastructure and hosting providersThese third-party services are outside of our control and may:- Become unavailable or experience outages
- Provide delayed, incomplete, or inaccurate data
- Change, restrict, or terminate access to their services at any timeAs a result:- Some or all features of the App may become temporarily or permanently unavailable

- Battery depletion, increased mobile data use, device overheating, reduced performance, app instability, or other device impacts associated with map rendering, three-dimensional views, location services, network activity, or extended screen useOur total liability shall not exceed the amount you paid (if any) to use the App.---15.
